Energy Surcharge

Effective September 1, 2010 through September 30, 2010: $2.02

The Energy Surcharge was implemented as a measure to maintain our product and service standards due to rising energy prices. The surcharge is based on the Monthly U.S. Average On-Road Diesel Price as published by the U.S. Department of Energy, Energy Information Administration on its website at http://tonto.eia.doe.gov/oog/info/wohdp/diesel.asp. Updated monthly, the Energy Surcharge appears as a separate line item on each statement.

The surcharge is adjusted monthly, and is indexed (see DS Waters Energy Surcharge Table) to the National U.S. Average On-Highway Diesel Fuel Prices reported by the U.S. Department of Energy for the calendar month ending at least one full calendar month prior to the effective date of the applicable adjustment. For example: the surcharge adjustment for August 2008 will be based on the average of the June 2008 National U.S. Average On Highway Diesel Fuel Price.

The amount of the surcharge may change dependent upon energy prices. It is our hope that energy prices will subside soon. However, we cannot predict what the following months will bring and we may need to adjust the amount of the surcharge.

We reserve the right to apply the surcharge in our sole discretion. Please note that we do not establish the Monthly U.S. Average On-Road Diesel Price. We will monitor the need to continue the surcharge and we will adjust accordingly.
